Privacy notice – GDPR

Policy pursuant to European Regulation 2016/679 (GDPR) as amended and supplemented

Data Controller: BESTWAY EUROPE S.P.A., with registered offices in San Giuliano Milanese (Mi), via Resistenza 5 (“BESTWAY”), Italy.

The Data Controller will process the following data:

 i) First and last name, e-mail address, shipping address, and phone number to provide you with the complaint management service by opening of a personalised account on the BESTWAY website, accessible by entering the Username and Password that will be communicated to you by e-mail – the latter to be changed upon the first access – and taking charge and proper management of your report of a disservice, for administrative and accounting purposes, for the fulfilment of legal or regulatory obligations.
 ii) for marketing purposes, to send you newsletters containing information and updates on BESTWAY products, services, events and offers, subject to your consent by ticking the appropriate box.
 iii) subject to your consent by checking the appropriate box, information such as gender, age range, employment status, motivation for product purchase, method of product purchase, and number of children in household may be collected for statistical purposes. This data is collected by BESTWAY to obtain an aggregate view of its customers without attempting to make predictions or draw conclusions specific to you, as the purpose is not to evaluate individual characteristics.
 iv) with your consent, by checking the appropriate box, we may email you a request to join a survey about our products and your experience using them;

The legal basis for the processing of the data referred to in point (i) is the establishment and execution of the contractual/commercial conditions and the applicable legal provisions; these data are obligatory and the refusal to provide them may prevent BESTWAY from fulfilling the requested service. With regard to points (ii), (iii), (iv)) the legal basis for this processing is your free and optional consent, and any refusal to provide such consent will only prevent you from receiving the aforementioned communications.

Your data will be processed by paper and electronic means in compliance with current legislation on personal data protection (EU Regulation 679/2016 or “GDPR” as amended and supplemented). The personal data you provide may be disclosed to third parties, such as persons, associations, professional firms and companies providing consultancy and support services and activities to BESTWAY (including companies of the BESTWAY Group which may be located outside the EU), in their capacity as Data Processors if duly appointed and provided that there are adequate safeguards in place for the protection of  personal data,  Joint Data Controllers or Independent Data Controllers, as well as BESTWAY personnel appointed as data processors only for the purposes described above. A full list of the Data controllers or Data processors to whom the data may be disclosed is available upon request.

For the purposes of complaint management described in (i), your data will be retained even after the termination of the contractual/commercial relationship with BESTWAY for the fulfillment of all obligations related to or arising from the conclusion of the relationship, including those related to legal obligations and statutes of limitation provided for this purpose by the applicable law and in any event for no longer than 10 years.

With respect to the marketing purposes described in (ii), your data will be stored for no longer than 8 years from the time you provide your permission. Customers may unsubscribe from the newsletter service at any time by clicking on the “unsubscribe” link contained in each email or by sending an email to privacy@bestwaycorp.eu.

For the purposes of statistics and surveys described in (iii) and (iv) above, your data will be stored for up to 8 years from the date we receive your consent.

You may at any time exercise all the rights set forth in Art. 15 et seq. of the Regulation, including, in particular, the right to access your personal data, the right to rectification, the right to erasure, the right to object to their processing, the right to data portability and the right to lodge a complaint with the Personal Data Protection Authority appointed in your Country (https://edpb.europa.eu/about-edpb/board/members_en).
